Writing Your Tenancy Agreement

After securing new tenants, it’s vital you have them sign a tenancy agreement to ensure that both yourself and the tenant are aware of all the terms and conditions and obligations of the tenancy.

Completing a written agreement at the start of the tenancy period will legally document the terms of the tenancy. This agreement will then need to be signed by yourself (or your agency) as well as the tenant. Finally a completed copy should be shared with all parties.

 

Items to include in the tenancy agreement:

Names of landlord and tenants.

The full address of the property that will be rented.

The rental fee that will be charged.

The way that tenants should pay rent to you (e.g. Bank transfer, cheque etc).

The process you will use if you wish to increase the rent.

State if the tenants have to pay any household / utility bills.

The amount of the tenants’ deposit.

The way that you will protect the tenants’ deposits.

Any situations (where terms of the agreement are broken) in which you would deduct money from their deposit.

The start and end date of the tenancy agreement.

Whether there are any specific responsibilities for the landlord or the tenant.

Any other specific requirements (for example, will the tenant be allowed pets at the property).

State if sub-letting will be accepted.

In the occurrence of rent arrears or other breaches of the agreement, state whether you will serve a section 8 notice to terminate the tenancy early.

It’s important to know

that you cannot take away your tenants’ rights even if they sign an agreement which attempts to restrict them.

Please be aware

You cannot include any terms in the tenancy agreement that could be considered unfair or could breach the law.

    • The team at James Laurence was very helpful when I tried to find an apartment in Birmingham. I was in contact with a different letting agency but things fell through and they couldn't help me. A colleague of mine recommended James Laurence Lettings so I emailed them immediately since I was was moving from Sweden and the move would take place in less than a week. The team at James Laurence responded within 5 minutes and managed to offer me a few different apartment-options. Things proceeded quickly and smoothly and just a few days later I had they keys to the apartment. James Laurence helped me every step of the way and went above and beyond to accommodate my requests. The only minor negative thing I can say is that the interntal communication could be improved a tiny bit. I received slightly different information depending on who I was speaking with at the time. When I said I received different information earlier the person I spoke to said she would talk to her colleagues and then get in contact with me later with the "correct" information which she did and the issue got solved very quick.

    • I recently sold my property with James Laurence, and the overall experience was great. They demonstrated a good knowledge of the Birmingham property market when discussing sales strategy, marketing and pricing (more than I was expecting) towards the beginning of my experience with them. This showed when we achieved 2 asking price offers within the first couple days of showings.
